The role of domestic violence in divorce, separation or custody arrangements

In the state of California, domestic violence comprises abuse or threats of abuse when the person being abused, and the abuser are in an intimate relationship, live together, or have a child together. Evidence or allegations of domestic violence affect your separation, divorce or custody arrangements. If one party is found to have committed a domestic violence act, the judge cannot give either joint or sole custody to that party, but that parent can be granted visitation rights. What restraining orders do

When domestic violence has occurred, the court can grant emergency domestic violence restraining orders with little or no notice to the other side. Restraining orders are designed to protect the victim of domestic violence and the children by ordering the abuser to move out of the family residence, stay away from and not attempt to contact the victim and the children, and stay away from the family residence, the children’s school, the victim’s workplace and the victim’s vehicle.

The victim may be allowed to record attempted contacts by the abuser, and the abuser may be ordered to attend anger management or other programs. The abuser will be ordered immediately to surrender any firearms he or she possesses. As part of the restraining orders, the victim may be awarded custody of the children.

In addition, when restraining orders are issued, they are placed into the California Law Enforcement Telecommunications System (CLETS) — the California law enforcement database — so that law enforcement will have access to the restraining orders and hence be able immediately to arrest the abuser should the order be violated.
